Using recoverfun

Purchasing Products

Our Services allow you to purchase home use therapy devices from us. We are constantly changing and improving our Services. We may add or remove functionalities or features, and we may suspend or stop a Service altogether.

You can browse our products without creating an account. However, if you want to make a purchase, you will need to create an account with us. When creating your account, you must provide accurate and complete information. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure. By placing an order through our Services, you agree to pay the purchase price for the products, as well as any shipping and handling charges and taxes as applicable. You are responsible for providing a valid payment method for your order. We accept major credit cards, PayPal, Apple Pay and Google Pay as payment methods. We reserve the right to cancel or reject any order at our sole discretion.

However, we do not warrant that such information is error-free, complete or current. We reserve the right to correct any errors or omissions in the information at any time without prior notice. Returns and Refunds

We also do not accept returns or exchanges for products that are lost or stolen during transit. We are not responsible for any products that are returned to us without our prior authorization.

Warranty

We offer a one-year limited warranty for our products. This warranty covers any defects in materials or workmanship under normal use during the warranty period. This warranty does not cover any damage or malfunction caused by misuse, abuse, negligence, modification or unauthorized repair. This warranty also does not cover any damage or malfunction caused by natural disasters, accidents, power surges or other external factors.

To claim the warranty, you must contact us at info@recoverfun.com with your order number and a description of the problem. We will provide you with instructions on how to ship the product back to us for inspection and repair or replacement. You are responsible for the shipping costs of returning the product to us. We will cover the shipping costs of sending the repaired or replaced product back to you.

We reserve the right to deny any warranty claim if we determine that the product is not defective or is not covered by the warranty. We also reserve the right to use refurbished or equivalent parts or products for any repair or replacement.

Our Services and products are provided “as is” and “as available” without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and title. recoverfun does not warrant that the Services and products will be uninterrupted, error-free, secure, accurate, reliable, or effective. recoverfun does not warrant that the Services and products will meet your expectations or requirements. recoverfun does not warrant that any defects or errors in the Services and products will be corrected.

You understand and agree that your use of the Services and products is at your own risk and discretion. You are solely responsible for any damage or loss that results from your use of the Services and products, including but not limited to any damage or loss to your computer, device, data, health, skin, or well-being. You are also solely responsible for complying with all applicable laws and regulations in your jurisdiction regarding your use of the Services and products.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

Limitation of Liability

To the fullest extent permitted by law, recoverfun and its affiliates, directors, officers, employees, agents, licensors, and partners will not be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or in connection with your use of or inability to use the Services and products, including but not limited to damages for loss of profits, revenue, data, goodwill, or other intangible losses. This limitation of liability applies whether the damages are based on contract, tort (including negligence), strict liability, or any other legal theory, and whether or not recoverfun has been advised of the possibility of such damages.

Some jurisdictions do not allow the limitation or exclusion of liability for certain damages, so some of the above limitations may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless recoverfun and its affiliates, directors, officers, employees, agents, licensors, and partners from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable attorneys’ fees) arising out of or relating to (a) your use of or access to the Services and products; (b) your violation of these Terms or any applicable laws or regulations; © your violation of any rights of any third party; or (d) any dispute or issue between you and any third party. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and in such case, you agree to cooperate with our defense of such claim.

Governing Law and Jurisdiction

You agree that any legal suit, action or proceeding arising out of or related to these Terms or the Services and products shall be instituted exclusively in the federal courts of the United States or the courts of the State of California in each case located in the city of San Francisco and County of San Francisco. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

Arbitration

At recoverfun’s sole discretion, it may require you to submit any disputes arising from these Terms or use of the Services and products, including disputes arising from or concerning their interpretation, violation, invalidity, non-performance, or termination, to final and binding arbitration under the Rules of Arbitration of the American Arbitration Association applying California law.

Waiver and Severability

No waiver by recoverfun of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure by recoverfun to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of these Terms will continue in full force and effect.

Entire Agreement

These Terms constitute the entire agreement between you and recoverfun regarding our Services and products, and supersede and replace any prior agreements we might have between us regarding the Services and products.

Changes to Terms

We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them. Your continued use of the Services and products following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page frequently so you are aware of any changes, as they are binding on you.
